SIT Set up to Seize Arms from Enrica Lexie, the Italian Ship
A Special Investigation Team has been set up by to seize arms from the Italian ships Enrica Lexie, as part of the investigation into the killing of the 2 Indian fishermen. The team, set up by the Kerala police will be headed by MR Ajith, CPC, Kochi. Further details will be announced shortly.
The decision to deploy an SIT came following the permission granted by Judicial Magistrate of Kollam court to Kerala Police to search the ship. Magistrate Dory Thomas issued an order, which authorized Kerala Police to make a search in order to seize the arms used by the Italian marines to shoot and kill the Indian fishermen. The petition was filed in the Kollam Magisterial court by SP Daniel Christie, who will also be part of the SIT.
Meanwhile a petition filed by the two marines Massimiliano Latorre and Salvatore Girone is likely to be filed in Kerala HC. This has been announced by a counsel on their behalf. Further details are awaited. The two marines would contend that the police force of Kerala has no authority to conduct inquiry into the case. They will also argue that Indian courts do not have any jurisdiction as the shooting incident happened beyond Indian territorial waters.
Earlier, Junior Foreign Minister of Italy rushed to India to quash the FIR charging the Italian marines. Sources related to the Foreign Ministry of Italy stated that he will “continue on a political level the action so far carried out by a delegation of experts from the Italian foreign, defence and justice ministries.” Italy’s Foreign Affairs Minister Giulio Terzi is also likely to visit India in this context next week.
