A city court has issued a fresh Non-Bailable Warrant against Shahi Imam of Jama Masjid Maulana Syed Ahmed Bukhari. This quashes a former plea made by the Delhi Police seeking the closure of a criminal case against. The case has been in the pending list for over 10 years. The fresh NBW was issued against Bhukari by Metropolitan Magistrate Rajinder Singh, along with a directive to the Delhi police of getting the warrant executed in 10 days time.
“In my considered opinion, declaring the accused Ahmed Bukhari as a proclaimed offender would be a mockery of law and it would provide an easy escape route to the accused. It is shocking to see that the police force is not able to execute the NBW issued against Bukhari. Such inaction on part of the police force cannot be tolerated,” said the Magistrate.
The Delhi police has drawn ample flak for its failure in executing the numerous NBWs which were issued on previous occasions. The court said that such instances of inefficiency will not be tolerated henceforth. The magistrate who issued the directive has also put aside the claims made by the Delhi Police that Bukhari’s arrest was put aside for fear of a communal backlash. The SHO of Lodhi Colony has been directed to execute the NBW personally. The court has declared Bukhari to be an offender as he has been making several public appearances, even as he abstained from the court summons.
Bukhari, on his part claims ignorance about the issuing of any NBW against him. “I am not aware of any NBW issued against me. I have never been served with summons either. I know there is a case against me but I have not been involved in any illegal activity. I just stopped the Government from demolishing a mosque and graveyard that is built upon the land of Waqf Board which the CPWD claimed to be its property. If that is a crime, yes I did commit a crime,” said Bukhari.
Syed Ahmed Bukhari has been accused of provoking a group on an illegal basis and forcibly preventing public servants from discharging their duty in Lodhi Colony police station area in September 2001.Inspite of a case being registered, Bukhari never turned up at the court. This made the court issue a NBW.
